The following Conditions of Sale (C.S.) regulate the sale of the goods (Products) marketed by Whitessence srl, with legal offices in Milan and working headquarters in Viterbo – 01100 – Via della Rimessa, 3 – p.Iva 04445850961 (Whitessence).
All contracts (Orders) for the sale of Products by Whitessence to their Clients are regulated by the following C.S. By accessing or using the site or submitting an Order, the Client therefore agrees to the C.S. according to articles 1341 and 1342 of the Italian Civil Code.
The C.S. do not compromise the rights of the Client under Italian law, provided that the client acts as a consumer and not with entrepreneurial or professional intentions.

1. Orders
1.1 The sale of Products is online. The Order will be automatically registered and completed according to these C.S. which the Client thus approves, as described in articles 1341 and 1342 of the Italian Civil Code. The Order may be changed after purchase only by telephone, fax, or e-mail, as provided on the website (contacts).
1.2 The Client agrees to the C.S. with each Order. The sale is considered complete at the moment the Order is registered. Whitessence reserves the right not to fulfil incomplete orders, or those which are not completed according to articles 3.1 and 3.3 of the C.S.
1.3 In the case that an order is not fulfilled due to product unavailability or other reasons, Whitessence will provide the Client with conditions of product delivery and/or payment reimbursement. This depends on each case and will be agreed upon in individual circumstances. In any case, the Client does not have the right to receive additional reimbursement or compensation.
2. Prices
2.1 All prices displayed on the site are expressed in Euros (€) and include any applicable value added tax, effective from July 20, 2010.
2.2 The prices of single products shown on the site are valid until December 31, 2011. Offers have the same expiration date unless otherwise indicated. In any case, the company reserves the right to bring any type of promotion into effect at any time.
3. Product Payment and Delivery
3.1 The Order amount should be made in one complete payment by credit card, wireless bank transfer, or cash on delivery (only valid for orders delivered on Italian territory, with an additional charge of € 2,00). Delivery to Italian territory is free for Orders equal to or more than € 39,00. A € 6,00 delivery charge applies to those Orders less than € 39,00. Delivery to other countries will be calculated on the internet site, indicating the best offer and giving the option when possible to choose between airmail and ground transportation. If a delivery estimate is not possible, the Client will be contacted by Whitessence via e-mail.
3.2 Delivery is carried out by means of postal or express couriers (“Carrier”) to the place closest to the address available to the Carrier, as indicated by the Client in the Order. Transportation does not include delivery to levels other than the ground floor.
3.3 The delivery is normally within 2 to 8 working days, from the moment Order payment confirmation is received. However all delivery estimates are purely approximations and not binding. Whitessence is not in any way responsible for either direct or indirect loss as a result of late delivery.
4. Product Characteristics
4.1 The Products presented on the website belong to the trademark Pèonyspa, property of Whitessence. Whitessence reserves the right, without notice and with the best of intentions, to modify primary and secondary Product packaging, in regards to what is displayed on the site.
4.2 All Pèonyspa Products are cosmetic products (article 1 law 713, October 11 1986 – Italian law) and are dermatologically and microbiologically tested. Whitessence does not guarantee the compatibility of Products with other products or equipment used by the Client.
4.3 Possible defects or damages apparent at delivery, and obviously due to the transportation, will be charged to Whitessence. There will be no loss to the Client on the condition that the Client records the damages with the Carrier upon receiving the Products.
4.4 Any claims should be sent to the operative offices of Whitessence within 8 working days of receiving the Products.
4.5 Whitessence is not responsible for improper use of its Products on the part of the Client or any other subject.
5. Disputes
5.1 For any legal dispute or controversy, the overseeing court is that in Viterbo, Italy.
Right to Cancel
In conformity with Italian law and in accordance with article 5, legislative decree 22.5.1999 n.185, the consumer may cancel any order by sending written communication in the form of certified mail, telegram, or facsimile within 10 working days of receiving the Products. The written cancellation notice should be sent to Whitessence srl, Via della Rimessa, 3 – 01100 Viterbo. Whitessence will then notify the client within 48 hours of receiving the order cancellation. The cancellation notice should indicate the order number and products being returned, and the preferred method of any possible credit. The consumer should return the products perfectly intact and in their original packaging, at the consumer’s own expense and care, within and not more than 10 working days of receiving the products. All returns should be made to Whitessence srl, located at Via della Rimessa, 3 – 01100 Viterbo. Whitessence will refund that due to the Client within the time specified by law.
